Appeals Court Rejects Trump’s Sweeping Tariffs

A federal appeals court has invalidated one of President Donald Trump’s most expansive trade measures, ruling that his use of emergency powers to impose sweeping tariffs exceeded presidential authority. In a 7–4 decision, the U.S. Court of Appeals for the Federal Circuit found that the International Emergency Economic Powers Act (IEEPA) does not authorize the president to levy tariffs, striking at the heart of Trump’s trade strategy.

The court delayed enforcement until mid-October, allowing the duties — covering nearly all U.S. trading partners — to remain in place while the administration seeks a likely Supreme Court review. The ruling affects tariffs that form roughly 70% of projected 2026 revenue, including levies on Canada, China, and Mexico.

Trump blasted the decision on Truth Social, calling the judges “highly partisan” and warning of economic disaster if his tariffs are undone. His administration has argued that curbing tariff authority could unravel trade agreements and spark financial instability. While the ruling curtails Trump’s reliance on IEEPA, other tariff powers remain available under separate trade laws. Still, the decision signals a major check on presidential authority, reinforcing that Congress—not the White House—holds constitutional power over taxation.
